End User Agreement
IMPORTANT – READ CAREFULLY BEFORE PURCHASING AND/OR USING HER TINY HOME’S TINY HOUSE PLANS
This End User Agreement (the “Agreement”) is a legal agreement between you (the “Purchaser”, “you”, “your”) and Shalina Kell, Her Tiny Home (the “Designer”). By purchasing and/or accessing these plans, you agree to be bound by the terms of this Agreement.
USE: These plans have been created strictly for illustrative purposes of Shalina Kell’s original tiny house design to be used as inspiration for a similar build and are not intended for construction. They do not have a professional stamp attached. Purchaser must work with a licensed builder, architect, and/or engineer if they choose to build a similar house based on these plans. The attached plans have not been checked for compliance with Purchaser’s local codes or conditions. It is the Purchaser’s responsibility to be familiar with local laws and building codes, and to consult with local building officials before building a new structure. If a house is to be built according to these plans, the Designer (Shalina Kell, Her Tiny Home) will not be held responsible for any damage or injury incurred. The Purchaser agrees to defend and indemnify the Designer against any and all liability, claims, costs, losses, or damages resulting from the use of these plans. Designer shall not be liable for direct, incidental, special, consequential, or indirect damages of any kind including but not limited to loss of anticipated profits, business opportunity, or other economic loss associated with the use of these plans.
OWNERSHIP: The sale of the attached plans constitutes a licensing of the design, not a sale of the original design. Ownership of the design and all copies is retained by the Designer. All intellectual property is reserved by the Designer.
LICENSE: This non-transferable Agreement grants the Purchaser permission to: construct ONE (1) single structure based on the attached plans, customize the attached plans, and print up to five (5) copies in addition to accessing them electronically, all for personal use only. Purchaser may make a single electronic back-up copy of the plans for archival purposes only. THESE PLANS MAY NOT BE USED FOR COMMERCIAL PURPOSES. Please contact Shalina Kell at [email protected] to discuss the use of these plans by commercial builders.
RESTRICTIONS: The attached plans, photos, or scans of the plans, and/or any altered or customized versions of the attached plans are not to be shared, reproduced, transferred, distributed, made available through electronic access (including posting photos on social media or online), sub-licensed, rented, resold, leased, or otherwise disclosed to any third party or used in any multiple-use arrangement. Purchaser agrees not to remove any copyright, logo, disclosures, or other proprietary notices on or in any portion of these plans as delivered and to retain all such notices on all authorized copies. The Purchaser agrees not to reproduce, distribute or make use of the content within these plans, including logos, drawings, specifications, text, photographs, or any other content without written permission.
HIRING CONTRACTORS: You may distribute one (1) hard copy to each contractor working on a single build based on these plans and for Purchaser’s own use, provided that such contractors do not use the plans to build any house other than the Purchaser’s house and they must destroy or return the hard copies upon completion of their work on the Purchaser’s house.
PURCHASE: All sales are final. There will be no refunds or exchanges issued once your order has been placed. Please contact Shalina Kell with questions about these plans prior to purchase at

DELIVERY: Plans will be delivered electronically in PDF format within 48 hours of purchase to the email provided at time of purchase. If there is a physical defect in the delivery of the plans, email [email protected] and you will receive a replacement delivery of the plans at no charge.
TERMS: This agreement commences on the day that the plans are purchased and is perpetual. Upon a breach of this contract, all electronic and hard copies of these plans in association with the Purchaser must be destroyed and/or returned to Her Tiny Home, and this agreement shall cease and terminate and you will have no further right to the use of these plans in any form, including electronic access, displaying at a build site, printing, reproducing, making copies, and/or making an archival back-up.
DISCLAIMER: The attached plans are delivered as-is. Designer does not guarantee that these plans will be free from errors and omissions, current, or perfectly accurate. Designer can not guarantee that the plans will comply with the particular codes and conditions in your area. You assume any and all risks in association with the construction of your house based on the attached plans. Designer does not guarantee a successful or satisfactory outcome for you based on the plans attached or that the outcome will meet all of your needs.
